The website, https://www.plus1nanny.com, from the +One agency, aims to disseminate all information about the services provided by our platform, including access to pre-screened and reliable nannies and cleaners, community chats and others resources.

Its content is protected by Copyright, Related Rights and Industrial Property Rights established in Portuguese legislation and European Union law, as well as by international conventions.

All information cannot be reproduced and its use for commercial or offensive purposes is prohibited.

Any attempt to change or insert information, or any act that may cause damage or put at risk the integrity of all or part of the website, are expressly prohibited and are punished in accordance with current legislation.

Access to and use of the website https://www.plus1nanny.com implies acceptance by the user of the terms and conditions referred to here by the +One agency, as data controller.

The content of this website, including brands, designs, logos, text, images, audio and video materials, is the property of the +One agency, unless otherwise indicated by a reference to its source, and is protected under the general terms of law and national and international legislation for the protection of Intellectual Property.

2. RESPONSIBILITY, USE AND RISK
​

The +One agency and all its legal guardians, workers and collaborators, as well as any other party involved in the creation, production, maintenance or implementation of this website, will not be responsible to any user of the website, for any possible damage, loss or injury (including any loss of profit and moral, indirect, accidental or consequential damages) arising from the correct or incorrect use of the website and its content.

The use of the website for illegal purposes or any other purposes that may be considered unworthy of the image of the +One agency is expressly prohibited. Usurpation, counterfeiting, taking advantage of usurped or counterfeit content, illegitimate identification and unfair competition are criminally punishable.

It is also prohibited for the user to create or introduce any type of virus or program that damages or contaminates this website or to advise third parties to do so. Violators will be subject to criminal prosecution.

These “Terms and Conditions” refer to the services to be provided by the Agency under the Service Provision Contract with Clients, and to the services to be provided by Candidates under the Contract to be concluded with the Agency.

These “Terms and Conditions” are applicable to all aspects of all contracts or agreements to be concluded verbally or in writing, between the Agency and Clients and between the Agency and Candidates.

Any change to these “Terms and Conditions” will only be valid if approved, in writing, by the Agency.

​

The Agency reserves the right to modify or alter these “Terms and Conditions” and will inform Clients and Candidates in writing of these changes at least 30 days in advance.

​

If any provision of these “Terms and Conditions” is considered illegal, invalid or unenforceable in any respect, such invalidity, illegality or unenforceability will not prejudice the application of the remaining provisions contained herein, to the extent that they are valid, legal and enforceable.

​

The Agency will take all reasonable steps to present Candidates to the Client who are of sound character, honest and trustworthy, but who cannot be held responsible for the conduct of a Candidate.

​

The Agency endeavors to ensure the suitability of the Candidate based on the information provided by the Client, but the Agency does not guarantee the suitability of any Candidate presented to the Client and makes no express or implied warranties or representations with respect to any Candidate. The final decision to hire a candidate is the sole responsibility of the Client.

​

The Client must therefore satisfy itself as to the suitability of the Candidate and the Client must consider any references provided by the Candidate and/or the Agency before engaging a Candidate. The Agency accepts no responsibility for any inconvenience, damage or loss resulting, directly or indirectly, from any act or omission of a Candidate introduced to the Client by the Agency. The Agency makes no guarantees as to the character, honesty, reliability, suitability or ability of the Candidate.

The Agency may provide the Client and the Candidate with a standard draft Employment Contract, but makes no representations in relation to that document and cannot provide any legal advice to either party as to its contents or the terms of employment between the Client and Candidate. or indeed any terms and conditions contained therein.

During the selection process of the Candidate to present to the Client, the Agency assumes the responsibility for evaluating the Candidate's qualifications, references and experience, collecting all the information considered necessary.

3. RESPONSIBILITY OF SITE USERS (CUSTOMERS)

Clients and Candidates must complete the online Registration Form to be accepted as clients. If this is not possible, they must sign the Terms and Conditions and return them to the Agency before they are accepted and registered. In the case of online registration, completing the online registration form constitutes confirmation of acceptance of the Agency's Terms and Conditions.

​

The Client must ensure that all information provided to the Agency is true and correct.

​

It is the Client's responsibility to verify whether the Candidates presented by the Agency meet the qualifications, skills and experience necessary to perform the intended services.

​

For the purposes of the previous paragraphs, the Client has the right to access all information collected about the Candidates selected by the Agency, will have the opportunity to interview them and will be responsible for choosing and hiring one.

​

The Client is responsible for communicating any complaint regarding the Candidate's performance in the execution of the services defined in the Service Provision Contract, to the Client, within five days after the date of the event that gave rise to it.

 

The Client must inform the Agency of the decision to terminate the provision of services by the Agency, at least 30 days in advance.

​

The Client undertakes to comply with other obligations arising from the Service Provision contract concluded with the Agency.

​​

4. CUSTOMER RIGHTS AND DUTIES
​​

The Agency cannot be held responsible for any errors in the candidate's portfolio as these are provided directly by the Candidate. The Client agrees to satisfy itself as to the Candidate's suitability by interviewing the Candidate, acquiring any references, copies of documents provided by the Candidate to the Agency and making appropriate checks on childcare qualifications or driving certificates prior to commencing employment or interview.

5. CANDIDATE’S RESPONSIBILITY
​

The Candidate must guarantee that all information provided to the Agency will be true and correct.

​

The Candidate undertakes to perform the services provided for in the Contract, concluded with the Agency, for the Clients indicated by the Agency.

​

The Candidate agrees to comply with other obligations arising from the Contract to be concluded with the Agency, including attending courses and training under the conditions defined therein.

​​

6. SERVICES
 

Access to pre-screened and trusted nannies and cleaners.

​

Community chats about expat life in the city, activities and local professionals.

​

A marketplace for buying and selling pre-loved items.

​

Charitable-related activities and donations.

​​

​

7. ELIGIBILITY
 

To use our services, you must be at least 18 years old. By using our website, you represent and warrant that you meet this age requirement.

8. USER ACCOUNTS
 

To access certain features of our services, you may need to create an account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

9. subscription and payment
 

Certain features of our services require a subscription. By subscribing, you agree to pay the applicable subscription fees and any related taxes. We reserve the right to change our subscription plans and fees at any time.

10. CONFIDENTIALITY
 

All communication, verbal or written, between the Client and the Agency and between the Candidate and the Agency, is confidential.

The presentation of Candidates to Clients is carried out individually and all information provided during this meeting is also confidential.

11. DATA PROTECTION
 

The Client allows the Agency to collect, store and process their personal data by the Agency.

​

The Agency is committed to complying with Personal Data Protection laws and other regulations intended to protect the processing of personal data, public freedom and the fundamental rights of natural and legal persons, and especially personal and family honor and privacy.

12. DISPUTE RESOLUTION
 

For the resolution of any dispute arising from the Service Provision Agreement between the Agency and Clients, the Lisbon District Court has exclusive jurisdiction, expressly waiving any other jurisdiction.
